Hello, my name is Benjamin Peña. I’m an immigration attorney.
I was born and raised in Harlem, a diverse immigrant-rich neighborhood in New York City. As a son to immigrants, I have dedicated most of my legal career to serving other immigrants. I founded A Lawyer From Harlem, P.C. to allow me to serve the immigrant community in a way that aligns with the things I find most important: transparency, empathy, and respect.
I am here to help you find solutions to your immigration problems.
También quiero mencionar que hablo español.

Services
Asylum and Humanitarian Relief
If you fear persecution, violence, or torture in your home country, you may be eligible for asylum. I can help you prepare a defensive asylum application if you are in court proceedings or an affirmative asylum application before USCIS.
Adjustment of Status
Adjustment of status is commonly known as a “green card application”. You may be eligible to get a green card without having to return to your home country for the consular process. I can help you prepare marriage-based and humanitarian-based applications for adjustment of status. You may be scheduled for an interview before USCIS. If you are in court proceedings, your application will be reviewed by an immigration judge. I can help prepare you for any interview or court hearing related to your adjustment of status.
Waivers
Waivers are commonly known as “pardons”. Waivers are used to cure inadmissibility issues that may be blocking you from being able to obtain your green card. I can help review your situation to see if you need a waiver. If a waiver is needed, I can help develop and prepare a waiver application package.
Removal Defense
If you or a loved one have a hearing scheduled to appear before the immigration court, I can represent you in your removal proceedings. Removal defense includes appearing for hearings such as master calendar hearings, individual hearings, and bond hearings. I can review your options to see if you are eligible for any forms for relief. If you have received a removal order in the past, it may be possible to reopen your court case.
Family-Based Immigration
If you are a United States citizen or a green card holder, you may be able to petition for your family members. I can help review your situation to see if you are eligible for a green card through family. If you have a conditional green card, you will need to apply to remove conditions on the green card. I can assist you with this and any other family-based immigration matter. I can help prepare you for any related interviews before USCIS.
Naturalization
Naturalization is the process by which a green card holder becomes a U.S. citizen. I can help you determine whether you qualify for naturalization. If you are eligible, I can help identify potential obstacles that may come up in your naturalization process. I can help prepare you for your naturalization interview.
